PARTICIPANT WAIVER, RELEASE & ASSUMPTION OF RISK

THE GRIND – PARTICIPANT WAIVER, RELEASE & ASSUMPTION OF RISK

By registering for and participating in The Grind Invitational (the “Event”), I acknowledge and agree to the following terms on behalf of myself, my heirs, executors, administrators, and assigns:

1. Assumption of Risk

I understand that participation in the Event involves inherent risks, including but not limited to: physical exertion, weather conditions, uneven terrain, golf equipment and golf balls, cart usage, interaction with other participants, spectators, volunteers, staff, and the general public, and the potential for serious injury, illness (including communicable diseases), property damage, or death.

I knowingly and voluntarily assume all risks, known and unknown, associated with participation in the Event.

2. Release of Liability

I hereby release, waive, discharge, and covenant not to sue:

-Firethorn Analytics, LLC

-The Grind Invitational

-The Tournament Committee

-Event sponsors, partners, and affiliates

-Host venue and property owners

-Officers, directors, members, employees, contractors, volunteers, agents, and representatives of any of the above

(collectively, the “Released Parties”)

from any and all claims, demands, causes of action, damages, losses, costs, or liabilities arising out of or related to my participation in the Event, including but not limited to personal injury, illness, death, or property damage, whether caused by negligence or otherwise, to the fullest extent permitted by law.

3. Indemnification

I agree to indemnify, defend, and hold harmless the Released Parties from and against any claims, liabilities, damages, costs, or expenses (including reasonable attorneys’ fees) arising out of or related to my actions, omissions, conduct, or participation in the Event.

4. Medical Treatment

I certify that I am physically fit and capable of participating in the Event. I consent to receive medical treatment deemed necessary during the Event and understand that I am solely responsible for any medical costs incurred.

5. Equipment & Conduct

I agree to abide by all Event rules, venue policies, instructions from Event officials, and standards of sportsmanship and conduct. I understand that failure to do so may result in disqualification or removal from the Event without refund.

6. Weather, Schedule & Event Changes

I understand that the Event may be modified, suspended, delayed, or canceled due to weather, course conditions, safety concerns, or other circumstances beyond the control of the Released Parties, and I agree that such changes do not create liability for the Released Parties beyond the terms of the published Cancellation & Refund Policy.

7. Media Release

I grant permission to the Released Parties to use my name, likeness, voice, and image captured during the Event for promotional, marketing, and archival purposes without compensation.

8. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of Maryland, without regard to conflict-of-law principles.

9. Acknowledgment

I acknowledge that I have read, understood, and voluntarily agreed to this Waiver and Release.
